The Swiss Federal Court has partially upheld a complaint by Brian Keller, a 28-year-old known offender, regarding his treatment in solitary confinement at Pfäffikon prison in 2017. Keller, who was held in isolation for 20 days under harsh conditions, was initially awarded a compensation of 1,000 Swiss Francs by the Zurich District Court, a decision later supported by the Zurich Higher Court.
However, the Federal Court found this amount to be "arbitrarily low," citing multiple violations of the European Convention on Human Rights.
Keller's confinement included sleeping without a mattress, wearing only a poncho, and being denied basic hygiene and visitation rights.
The Federal Court has ordered the Zurich Higher Court to reassess the compensation, emphasizing that the authorities failed to ensure humane detention conditions despite Keller's aggressive behavior.
This ruling marks another instance where the Federal Court has corrected Zurich's handling of Keller's incarceration.
